3. Required Elements of a Valid Notice
To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- Identification of the copyrighted work — A description of the work you claim has been infringed. If multiple works are covered by a single notice, a representative list is sufficient.
- Identification of the infringing material — A description of the material you claim infringes your copyright, with sufficient information to allow us to locate it on our platform. Providing the direct URL to the model page is the most efficient method.
- Your contact information — Your name, mailing address, telephone number, and email address.
- Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement — A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorised to act on the copyright owner's behalf.
- Physical or electronic signature — A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
Notices that are missing any of the above elements may not be actionable. We reserve the right to request additional information before acting on incomplete notices.
4. Counter-Notice Procedure
If content you uploaded was removed following a DMCA notice and you believe the removal was in error (e.g., the content is your original work or covered by a licence or fair use), you may submit a counter-notice under 17 U.S.C. § 512(g).
A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the removed content and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the US, any judicial district in which ModelDirectory.org may be found), and that you will accept service of process from the person who filed the original notice.
Send counter-notices to [email protected] with the subject line DMCA Counter-Notice.
Upon receipt of a valid counter-notice, we will forward a copy to the original complainant. If the complainant does not file a court action within 10–14 business days, the removed content may be reinstated at our discretion.
